These Terms and Conditions (“Terms”) govern your access to and use of the VelociFuel website and mobile application (collectively, the “Services”) operated by VelociFuel (“VelociFuel,” “we,” “us,” or “our”).

By accessing or using the Services, you agree to be legally bound by these Terms. If you do not agree, you may not use the Services.

You must be at least 18 years of age to use the Services. By using VelociFuel, you represent and warrant that you meet this requirement and have the legal authority to enter into this agreement.

VelociFuel provides on-demand fuel delivery services to approved vehicles and serviceable locations.

Service availability may vary based on:

• Location
   
• Fuel type
   
• Weather conditions
   
• Safety considerations
   
• Operational capacity
   

VelociFuel reserves the right to refuse, cancel, or discontinue service at any location deemed unsafe, inaccessible, non-compliant, or unlawful.

By using VelociFuel, you agree to:

• Provide accurate, complete, and current information
   
• Select the correct fuel type
   
• Ensure your vehicle is legally eligible for fueling
   
• Ensure the vehicle is turned off and accessible
   
• Ensure the delivery location is safe and free of hazards
   
• Comply with all applicable federal, state, and local laws
   

VelociFuel is not responsible for damages resulting from incorrect or incomplete information provided by you, including incorrect fuel selection.

Fuel delivery requires:

• Vehicle engine turned off
   
• Accessible fuel door and cap
   
• No open flames, smoking, or hazardous conditions
   

VelociFuel may pause, delay, or terminate service if unsafe conditions exist.

If incorrect fuel type is selected by the user, VelociFuel shall not be liable for resulting damages.

• Prices are displayed at the time of order and may include service or delivery fees.
   
• Payment is required at the time of placing a service request.
   
• VelociFuel uses third-party payment processors and does not store full card details.
   
• Failed, reversed, or disputed payments may result in account suspension or termination.
   

VelociFuel reserves the right to correct pricing errors.

• Orders canceled after dispatch may incur a cancellation fee.
   
• Completed services are non-refundable.
   
• Refunds, if issued, are granted at VelociFuel’s sole discretion.
   

By providing your mobile phone number and opting in through the Services, you consent to receive SMS messages related to:

• Service confirmations
   
• Delivery updates
   
• Account notifications
   
• Customer support
   

Message frequency may vary.
Message and data rates may apply.

You may opt out at any time by replying STOP to any message.
For assistance, reply HELP.

Consent to receive SMS messages is not a condition of purchase.

VelociFuel is not responsible for delays or delivery failures caused by mobile carriers.

By using the Services, you consent to receive communications from VelociFuel electronically, including via email, SMS, or app notifications. You agree that such communications satisfy any legal requirement that communications be in writing.

You are responsible for maintaining the confidentiality of your account credentials. You must notify VelociFuel immediately of unauthorized account use.

VelociFuel is not responsible for losses resulting from unauthorized access due to user negligence.

You agree not to:

• Use the Services for unlawful purposes
   
• Provide false or fraudulent information
   
• Interfere with the Services or systems
   
• Harass or endanger VelociFuel personnel
   
• Resell or commercially exploit the Services without written consent
   

All content, trademarks, logos, branding, designs, and software are the exclusive property of VelociFuel and may not be reproduced without written permission.

The Services are provided on an “as is” and “as available” basis. VelociFuel makes no warranties, express or implied, regarding service reliability, availability, or uninterrupted operation.

To the fullest extent permitted by law, VelociFuel shall not be liable for:

• Indirect, incidental, special, or consequential damages
   
• Service delays or interruptions
   
• Damages caused by incorrect user information
   
• Acts beyond VelociFuel’s reasonable control
   

VelociFuel’s total liability shall not exceed the amount paid by the user for the specific service giving rise to the claim.

You agree to indemnify and hold harmless VelociFuel from claims, damages, liabilities, or expenses arising from:

• Your misuse of the Services
   
• Your violation of these Terms
   
• Inaccurate or unlawful information you provide
   

VelociFuel shall not be liable for failure or delay caused by events beyond reasonable control, including natural disasters, severe weather, governmental actions, labor disputes, or supply shortages.

Any dispute arising under these Terms shall first be resolved through good-faith negotiations.

If unresolved, disputes shall be resolved exclusively in the state or federal courts located in the State of Georgia.

You waive any right to participate in class actions or jury trials where permitted by law.

These Terms shall be governed by the laws of the State of Georgia, without regard to conflict-of-law principles.

If any provision of these Terms is found unenforceable, the remaining provisions shall remain in full force and effect.

VelociFuel may update these Terms at any time. Continued use of the Services after changes are posted constitutes acceptance of the revised Terms.
